INCREMENTO DE RENTA EN ARRENDAMIENTO URBANO POR OBRAS DE MEJORA

Cuestión:

Mi casero ha realizado una serie de mejoras en el inmueble en el que vivo. Como consecuencia de estas mejoras me comunica que se va a subir el precio de la renta que pago en la actualidad. ¿Puede hacer esto? ¿a cuanto puede ascender como máximo el incremento de mi mensualidad?

Contestación:

Esta es una de las cualidades que tiene el arrendador en caso de que mejore la vivienda o los servicios de la misma. La subida de la renta se producirá desde el mes siguiente a aquel en que finalizadas las obras y el arrendador notifique por escrito al arrendatario la cuantía en base a los documentos de los que resulte el coste de las obras realizadas y se aplicará siempre al mes siguiente a la notificación. Pero existen unos límites en los que la renta no se podrá elevar dentro de los cinco primeros años de contrato y en segundo lugar que la renta se elevará conforme a la cantidad que resulte de aplicar al capital utilizado y además no puede exceder del 20% de la renta.

Si usted como arrendatario se negará a pagar esta elevación, el arrendador podrá reclamar judicialmente estas cantidades y resolver el contrato.

En caso de que las mejoras afecten a varios pisos el arrendador repartirá de forma equitativa la elevación de los mismos entre todos los inquilinos.
