Nueva Ordenanza de instalación de ascensores en la ciudad de Madrid

La presentación el pasado mes de abril del proyecto inicial de la Ordenanza que regulará la Instalación de Ascensores en las Fachadas de Edificios Construidos de Uso Residencial, (OIAFECUR), a falta de concretar su denominación final y su aprobación, plantea en principio varios interrogantes fundamentales. ¿Cómo contempla esta Ordenanza la instalación de estos sistemas de accesibilidad?, ¿qué requisitos principales desarrolla?, son algunas de las cuestiones a resolver.

Para situarnos, y como principio regulador de esta Ordenanza, es indispensable que el edificio carezca de una instalación o aun teniéndola, no reúna las condiciones de accesibilidad necesaria, debiendo además constituir la única solución técnica o económicamente viable para la subsanación de dicha carencia y que no afecte a locales o viviendas en el uso residencial colectivo.

La nueva OIAFECUR nace principalmente como necesidad de desarrollar dos casos especiales de ocupación de dominio público que las Normas Urbanísticas (NNUU) ya planteaban, losrelativos a los artículos 7.8.3.5 (en zonas verdes) y 7.14.5.3 (ámbitos devía pública), ambas colindantes con edificios residenciales existentes.

Como novedad de la Ordenanza, en la Disposición Adicional Única se extrapolan las condiciones generales para su utilización en las situaciones de suelo libre privado.

La ocupación en suelo privado de uso público en edificios existentes de bloques abiertos ya está regulada en el Acuerdo de la Comisión de seguimiento (ACS nº 121).

Jurídicamente este tipo de obra está calificada en la Ordenanza como reestructuración Parcial y por tanto necesitará de un procedimiento Ordinario Común de licencia regulado en la OMTLU. Además, ahora viene indicado el cumplimiento de la Ordenanza de Gestión de Obras en la Vía Pública en relación con la interferencia en la obra de urbanización (acerado, peldaños, pavimentos, etc.), que afecte al espacio público afectado.

Salvaguarda estética

Esta Ordenanza no sólo se focaliza en el cumplimiento normativo, sino que también prevé la salvaguarda estética urbana e imagen de la ciudad, punto que esperemos no lleve acarreado un incremento en costes para la comunidad de dicha instalación de accesibilidad. Deja a interpretación de los técnicos municipales de su conveniencia o no de realizarla según se solicita. Tanto es así que si el edificio está englobado en un conjunto o complejo inmobiliario, se deberá realizar un informe de la configuración final de la fachada y adecuar la instalación estéticamente a estos edificios de similares características.

Una “ventaja positiva” que se introduce en el preámbulo es que no es necesaria la espera de la conformidad técnica de las empresas de suministros cuando éstos se vean afectados, pero sí la solicitud a los mismos de las obras que ellos consideren necesarias para estas modificaciones. Si bien en su art. 12.2 indica “que en todo caso es obligatorio la conformidad para la modificación de éstas”, no aclarando si es o no técnicamente posible.

En el ámbito de la Ley 8/2013, de 26 de junio, se ha modificado la LPH, introduciendo varios cambios. Así, en el art. 10.1.b), pasa a ser obligatoria sin acuerdo de junta, la instalación de sistemas de eliminación de barreras arquitectónicas cuando el importe repercutido anual no supera la anualidad de gastos comunes.

Cuando la posibilidad de accesibilidad en la comunidad es su instalación por patios o adosados a fachada, la Ordenanza regula y favorece su instalación, indicando que no computará a efectos de edificabilidad, ocupación o volumen y no supone la alteración de la calificación del suelo.

La instalación de las torres de ascensores ya sean en patios o en fachada, deberán posibilitar el acceso a éstas y la NNUU es clara a esta cuestión cuando dice que “el acceso a dichos patios cumplirá la normativa de aplicación para personas discapacitadas o de movilidad reducida si los mismos tienen uso comunitario”.

Tramitación

La Ordenanza va más allá y permite, cuando se instale en el exterior ocupando espacio público, hasta la reducción de 1,50 en el ancho mínimo de paso y excepcionalmente a 1,20 m. Hay que entender que gasto de la instalación no sólo implica la instalación del aparato elevador, sino la adecuación del patio y la infraestructura de urbanización, para cumplir además la normativa de accesibilidad.

Esta puntualización es importante y se debe englobar como cómputo del importe del art. 10.1.b).

En la Ordenanza se regula claramente el procedimiento y además de la documentación general aportada hasta ahora en la solicitud de licencia, se exige toda una serie de documentación específica que englobará el Proyecto firmado por un técnico

competente. Como principal requisito se requerirá un Certificado por técnico del Proyecto, acreditando que es la única solución técnicamente viable.

Una vez emitido informe por el Órgano Competente autorizando la instalación a la vista de la documentación presentada, se deberá pasar una serie de informes preceptivos según los casos particulares de cada comunidad. Todo enfocado en la constitución económica del aval o equivalente en metálico que se deberá presentar anterior a la ejecución de la obra (15 días antes de la comunicación de replanteo o inicio).

No cabe duda que una regularización tan pormenorizada, incurrirá en una tramitación más clara para su correcta implantación en las comunidades.
