Cuestión:
Inicié la venta de una casa de mi propiedad dando al comprador doce meses para pagarla, figurando esta cláusula en el documento de venta. El comprador me hizo entrega de una cantidad como señal y primer pago figurando también en el contrato.
Sin que figure en el contrato acordamos que todos los meses el comprador me haría entrega de dinero, pero han pasado siete meses y no me ha pagado una peseta. En el contrato no figura ningún tipo de indemnización en caso de ruptura ni para el comprador ni para el vendedor.
Mi pregunta es: ¿Si vendo a otra persona la casa antes de concluir los doce meses pactados, que indemnización me puede reclamar el comprador?
Contestación:
El contrato de compraventa celebrado les obliga tanto a usted como al comprador a cumplirlo hasta los doce meses pactados. Esta obligación pactada por escrito se impone sobre los acuerdos verbales realizados anteriormente, salvo que usted tenga una prueba de ellos.
Si usted, decide por su cuenta vender la casa a otra persona, deberá saber que estará entonces incumpliendo el contrato. Ante tal situación, el comprador podrá entonces solicitarle: o bien que cumpla el contrato, es decir, deberá usted respetar el plazo pactado de doce meses, durante el cual el comprador podrá dar cumplimiento a su obligación de pagar el precio o, reclamarle las cantidades satisfechas más los intereses legales y así mismo la indemnización a la que usted hace referencia, que comprenderá todos aquellos daños y perjuicios que el no cumplimiento del contrato por su parte le hubiese ocasionado al comprador, daños que serán valorados por éste en función de todas las pérdidas ecónomicas (v.g venta de una vivienda para comprar ésta, solicitud de préstamo para pagar parte del precio……) que la frustada compraventa realizada con usted le hubiera supuesto.
