Conforme a lo dispuesto en la nueva Ley de Arrendamientos Urbanos de 1994, es obligación de la persona que pretende subrogarse en el contrato de arrendamiento y que tenga derecho a ello notificar al arrendador dentro de los tres meses siguientes al fallecimiento del arrendatario:
1. El fallecimiento (certificado de defunción)
2. La identidad del subrogado indicando su parentesco y ofreciendo un principio de prueba de su derecho.
En caso contrario se extinguirá el contrato quedando solidariamente obligados al pago de las rentas de dicho periodo los que pudiran suceder al arrendatario (salvo que hubieran notificado por escrito al arrendador su renuncia a su opción dentro del mes siguiente al fallecimiento del arrendatario) y los que hubieran efectuado tal notificación reclamando su derecho de subrogación y mantuvieran su pretensión de subrogarse.
Por ello entendemos que si es posible instar la demanda de desahucio pues el contrato quedó extinguido por no haberse notificado en plazo al arrendador la muerte del arrendatario.
