¿QUE ES UN TESTAMENTO?

Es el acto por el cual una persona dispone para después de su muerte de todos sus bienes o de parte de ellos.

Para calificar como testamento un acto es necesario que se manifieste una verdadera intención de testar, por lo que no lo será el que presentando la forma externa de testamento, origine dudas sobre si constituye un simple esbozo o proyecto y no un acto definitivo.

Como características del testamento cabe destacar: es obra de una sola persona, se prohibe que dos o más personas puedan testar mancomunadamente o en un mismo instrumento. Asimismo, es un acto personalísimo, no cabe ni que se deje a un tercero, ni su nombramiento como mandatario o comisario para ese fin.

Por otra parte, la declaración de voluntad que se realiza en el testamento no requiere que sea conocida por los interesados (herederos, legatarios etc..) para que despliegue sus efectos.

La última voluntad se ha de manifestar necesariamente a través de las formas predeterminadas por la ley, de modo que si no se cumplen no puede reconocerse su existencia.

El testamento es esencialmente revocable hasta el momento de la muerte, y asímismo éste despliega sus efectos a la muerte del testador. El testamento posterior revoca el anterior siempre que sea perfecto, salvo que el testador exprese en el nuevo su voluntad de que aquél subsista en todo o en parte.

Pueden testar todos aquellos a quienes la ley no se lo prohibe expresamente. No pueden otorgar testamento, los menores de 14 años (excepto si se utiliza la forma ológrafo, que es aquel que escribe el testador por si mismo, y para el que se requiere mayoría de edad), y que habitual o accidentalmente no se hallare en su cabal juicio.

Nuestro Código Civil contempla tres tipos de testamentos comunes: ológrafo, cerrado y abierto. El primero, como ya he señalado, solo podrá otorgarse por personas mayores de edad, y para que sea válido deberá estar enteramente escrito y firmado por el testador.

El testamento abierto es aquel que el testador manifiesta su última voluntad en presencia de las personas que deben autorizar el acto quedando enteradas de lo que se dispone en el mismo. Es un testamento notarial que ha de ser autorizado por Notario competente para actuar en el lugar del otorgamiento.

El testamento es cerrado cuando el testador, sin revelar su última voluntad, declara que ésta se halla contenida en el pliego que presenta a las personas que han de autorizar el acto. Puede ser escrito por el testador o por otra persona a su ruego, en cualquier caso en papel común con expresión del año, mes y día en que se otorga.
