La subrogación consiste en la sustitución de una de las partes contratantes de la relación arrendaticia (arrendador/arrendatario) por un tercero que asume sus derechos y obligaciones.
Puede ser un tercero que ocupe la posición del arrendador, o un tercero que ocupe la posición de arrendatario. Y en este sentido aparecen dos tipos de subrogaciones
Subrogaciones en la posición del arrendador
Quien adquiere una vivienda arrendada asume los mismos derechos y obligaciones que tenía el arrendador transmitente hasta que transcurran los cinco años de duración mínima del arrendamiento, si estos todavía no han transcurrido. En este caso el nuevo adquirente no podrá ampararse en la protección y publicidad registrales, y prevalece en todo caso, el derecho a disfrutar la vivienda por parte del arrendatario durante el plazo mínimo de duración del contrato de arrendamiento.
Sin embargo, si el contrato se ha pactado con una duración superior a cinco años, el nuevo arrendador, tan sólo estará obligado a la subrogación en caso de no tener la protección registral anteriormente citada, pues de tener esta, el nuevo arrendador no quedará obligado a soportar la carga arrendaticia más allá del período legal de cinco años. Transcurrido dicho plazo el arrendamiento se extinguirá, debiendo el anterior arrendador indemnizar al arrendatario por cuantía equivalente a una mensualidad de renta por cada año de contrato que restase por cumplir tras el transcurso de los cinco iniciales.
Si en el propio contrato de arrendamiento se hubiese pactado como causa de extinción del contrato la transmisión de la vivienda arrendada, el nuevo arrendador quedará eximido de la carga arrendaticia una vez transcurrido el período inicial de cinco años aún careciendo de la protección registral (aunque en cualquier caso se seguirá respetando el plazo mínimo de los cinco años con la obligación de subrogación para el adquirente por dicho período legal).
Subrogaciones en la posición de arrendatario :
Si el arrendatario (titular del arrendamiento) desistiera del contrato sin consentimiento del cónyuge que viviera con el, el cónyuge podrá subrogarse en la misma posición que tenía aquel. El arrendador tendrá entonces la facultad de solicitar a dicho cónyuge si desea mantenerse en el arrendamiento, y si en un plazo de quince días, no contesta al ofrecimiento, perderá su derecho a la subrogación además de verse obligado a satisfacer la renta pendiente de pago hasta la extinción del contrato.
Si el arrendatario (titular de la vivienda) abandonara la misma sin un desistimiento expreso, su cónyuge si conviviera con él, podría continuar en el arrendamiento, siempre que en el plazo de un mes tras producirse el abandono, el arrendador reciba notificación escrita del mismo solicitando ser el nuevo arrendatario.
En el caso de separación, divorcio o nulidad del matrimonio del arrendatario, el cónyuge no titular del arrendamiento podrá continuar en el uso de la vivienda arrendada cuando le sea atribuida como consecuencia de adjudicación judicial o por convenio, relativos a la separación, divorcio o nulidad matrimonial.
En caso de muerte del arrendatario, la Ley establece una enumeración de personas con derecho a subrogarse, es decir, ponerse en el lugar de arrendatario, con sus mismos derechos y deberes. La enumeración por orden de preferencia es la siguiente:
a) El cónyuge a la fecha de fallecimiento.
b) la persona que hubiera venido conviviendo de forma permanente durante los dos años anteriores en análoga relación de afectividad con independencia de su orientación sexual.
c) los descendientes del arrendatario bajo patria potestad o tutela al momento de fallecimiento, o, que hubiesen convivido con él durante los 2 años anteriores al fallecimiento.
d) los ascendientes (convivencia 2 años).
e)Hermanos (igual período de convivencia de 2 años).
f)Personas distintas a las anteriores que sufran una minusvalía igual o superior al 65% siempre que sean parientes hasta el tercer grado colateral del arrendatario (más el período de convivencia de 2 años).
- Pluralidad de beneficiarios
En caso de que se produzca una solicitud de personas de igual grado en la prelación, se resolverá a favor de quien tuviese minusvalías de al menos un 65%; en su defecto, de quien tuviera más cargas familiares; en última instancia, en favor del descendiente de menor edad, el ascendiente de mayor edad o el hermano más joven.
- Notificación
El subrogatario en el plazo de tres meses deberá notificar por escrito la subrogación al arrendador acompañado del certificado de defunción y su condición de subrogatario. Si no se recibe la notificación en el citado plazo, se extinguirá el arrendamiento quedando los beneficiarios de la subrogación, excepto los que hubieren notificado su renuncia, solidariamente obligados al pago de la renta de dichos tres meses.
- Estipulación expresa
Se podrá también pactar entre arrendatario y arrendador excluir el derecho de subrogación mortis-causa, para cuando éste tuviera lugar transcurridos los cinco primeros años de duración del arrendamiento.
