En nuestro derecho se da una especial relevancia a los acuerdos entre los cónyuges como consecuencia de la separación, divorcio o nulidad del matrimonio, por hacerse necesaria la regulación de estas situaciones jurídicas. Como consecuencia de estos acuerdos es necesario resaltar lo que en la legislación española se denomina el Convenio Regulador. Éste significa el reconocimiento de la actuación de la autonomía privada en tanto en cuanto nadie conoce mejor la realidad que los propios interesados.
También existen otras personas, como son los hijos del matrimonio, cuyo interés hay que proteger, por lo que no basta que el convenio únicamente sea acordado por el matrimonio para que despliegue toda su eficacia, siendo necesaria su aprobación por la autoridad judicial.
La ley exige que los cónyuges al presentar la demanda de separación o de divorcio de mutuo acuerdo o interpuesta por uno con el consentimiento del otro se acompañe la propuesta de convenio regulador.
El convenio regulador debe contener unos requisitos mínimos, en tanto en cuanto debe referirse al menos a los siguientes extremos:
Determinar la persona a cuyo cuidado han de quedar los hijos, sujetos a la patria potestad de ambos, el ejercicio de ésta y el régimen de visitas de los hijos con el progenitor que no tiene la custodia de ellos.
Atribución del uso de la vivienda y del ajuar familiar
Contribución a las cargas del matrimonio y alimentos, bases de actualización, y en su caso, garantías.
La liquidación, cuando proceda, del régimen económico conyugal.
La pensión que correspondiere satisfacer a uno de los cónyuges.
Este último punto se refiere a la llamada Pensión Compensatoria, que es aquella que se abona al cónyuge cuya situación después de la separación o el divorcio haya quedado desequilibrada con relación a la posición del otro, implicando un empeoramiento en relación a la situación anterior en el matrimonio.
En cualquier caso, y como hemos señalado al principio, el convenio regulador está sometido a la aprobación judicial, ya que el Juez tratará de velar porque los acuerdos no sean perjudiciales ni para los hijos ni para ninguno de los cónyuges.
Es posible que el convenio regulador pueda ser modificado posteriormente cuando las circunstancias se alteren sustancialmente.
